Terms
The Residence Application/Agreement must be executed prior to taking occupancy in a student residence at Mills College. The Residence Application/Agreement is a legal and binding contract between Mills College (the College) and the individual signatory (the student resident). A residence at Mills can be a residence hall, apartment, cooperative, or an assigned space within one of these dwellings. This agreement is for a space in a residence of Mills College and not for any particular residence or room. By signing the Residence Agreement, the student resident accepts her/his residence assignment and agrees to pay all applicable residence charges assessed by the College. The resident also agrees to comply with all policies governing occupancy of a College residence; to be respectful of and compliant with the Residential Life Staff; and to be considerate of the rights of other residents at all times. This includes not engaging in any behavior that intimidates, harasses, or threatens any person or group for any reason, and particularly because of race, culture, class, nationality, religion, gender, sexual orientation, or physical or mental ability. The provisions of this agreement apply to the occupancy periods of each residence type, as well as for periods during which specific students are granted permission by the Director of Residential and Commuting Life to be in residence outside of a regular contract occupancy period. Such periods may include, but are not limited to, Commencement and Orientation.

Conditions

Residence Charges
By signing for a residence under this agreement during the academic year, a resident is obligated to pay the residence charges for the entire contract period or remainder thereof. In addition to the residence and meal plan charges, the College may also assess charges for loss of or damage to College property, unauthorized occupancy, violation of College policy, and late payment on established charges. Residents may not move into their assigned residences until they are financially cleared by the M Center.

Eligibility and Authorized Occupancy
Eligible residents under this contract must be registered as undergraduate or graduate students at Mills College, and not in absentia.

Single women students and women students who are attending Mills without a spouse, a partner, or children may be assigned to Ethel Moore, Mary Morse, Orchard Meadow, Warren Olney, or Ege Halls. Graduate men will be assigned to the Courtyard Townhouses. Undergraduates who have Junior or Senior class standing, or who are over age 23, are eligible for assignment to Prospect Hill Apartments or Larsen House Co-op. Women undergraduates aged 23 or older and female graduate students are eligible for Ross House. Mills undergraduates or graduates who wish to live with their dependent children may apply for assignment to Underwood Apartments. If a resident's family status changes, she/he may become ineligible for Underwood Apartments the following semester. Residences are to be used for private dwelling purposes only and are to be occupied by residents (and approved family members in Underwood Apartments) and by no other person(s). Any change in occupancy, including change of roommate assignments, must be approved by Housing Management and Dining Services. Failure to report changes in occupancy may be grounds for termination of this agreement and/or loss of residence privileges.

Unauthorized Occupancy
If a resident occupies a College residence without authorization before her/his official move-in date, after her/his official termination of occupancy date, after the official closure of residences for Winter or Summer breaks, or at any time outside her/his contract occupancy periods, a charge of $50 per day and the current daily rate for room and board will be assessed until the space is completely vacated. The College also reserves the right to assess this daily charge if a resident continues to occupy a College residence after her/his eligibility for residency has ceased. Occupancy of a College residence without authorization is cause for terminating prospective agreements for residence and for refusing to grant future residence privileges.

Agreement Renewal
Eligible undergraduates may sign yearly Residence Agreements for Underwood Apartments or the Ross House for a period not to exceed four years. Eligible graduates may sign yearly Residence Agreements for Underwood Apartments for a period not to exceed two years. Eligible undergraduates may participate in the selection process for Prospect Hill or Larsen House Co-op during the Spring semester. Continuing undergraduates and graduates may participate in Room Draw in the Spring to select a residence hall room for the following Fall. Students may not renew for more than one particular residence. A new contract must be signed for each rental year. The College is under no obligation to renew a contract. Renewals for Underwood Apartments are contingent on the order of priority among all applicants, and students cannot count on continuing occupation in Underwood Apartments from year to year if their priority is lower than that of new applicants.

Termination of Agreement or Release from Agreement
The College has the right to terminate this contract immediately for breach of residence policies, misconduct in violation of others' rights, disruption to the educational environment, endangerment to health and/or safety, or the use of false statements in this agreement. The College also reserves the right to deny future residence privileges or impose other disciplinary penalties for such breaches and misconduct. Students who lose their residence privileges due to breach of this agreement are fully liable for the entire term of the agreement. Determination of breach and all decisions about petitions for continuation of residency despite breach are made by the Housing Policies and Procedures committee. Whenever a resident loses the status of registered student (enrolled in a minimum of 2.0 credits), she/he must vacate the College residence within five days with no right of appeal or exception.

Residents may be automatically released from this agreement only if they academically withdraw, take a leave of absence (terminating their registration), are academically disqualified, or attend an approved Study Abroad or Domestic Exchange program. Students in these circumstances will be released from their obligation to pay housing charges only if they are released from their agreements prior to the commencement of the occupancy period of the agreement.

All decisions regarding release from this agreement are made by the Housing Policies and Procedures committee. Requests for release based on compelling and unforeseen circumstances must be submitted in writing to the Housing Management and Dining Services office. A decision on the written request will be made within 15 work days of its submission. Refunds for release from financial obligation are based on the refund policy stated in the College Catalog. After the start of the occupancy period of the housing agreement there will be no refunds of housing charges, unless an exception to the refund policy is made at the discretion of the Housing Policies and Procedures committee. Refunds of meal plan charges are based on the date of check-out from the assigned residence.

Security/Reservation Deposit
A deposit is held by the College as security for room reservations (and for damages associated therewith), and against cleaning charges and/or repair costs. Security/reservation deposits are not maintained during periods of Leave of Absence, Study Abroad, or Domestic Exchange. Residents may not apply the deposit toward charges owed for occupancy. The amount of security/reservation deposits varies according to type of residence.
